PROFAN SPORTS Sponsor Agreement

National Golf Challenge, Fantasy Football Tournament of Leagues

 

Please review the following terms and conditions. They will  be included in each Sponsor’s Sponsorship Agreement.

1. Sponsor Pledge and Donation

Sponsors pledge to pay and/or donate an amount based on the sales generated during each tournament. The pledge amount will be listed under their logo on their tournament page. They can increase the amount at any time. Sponsors agree to donate said amount to the junior golf organization (Golf) or nonprofit organization (Football) selected by each tournament’s champion. Sponsors agree to donate or pay this fee on such date designated in advance by PFS.

2. Sponsor Involvement

Sponsor agrees to provide information about their involvement in the National Golf Challenge and/or the Fantasy Football Tournament of Leagues (programs) on the company website. Sponsors are encouraged to use social media and other marketing efforts to increase sales, donations, and program participation.

3. Sponsor Process

Golf Challenge
Starting September 1, 2021, every month thereafter, PFS will select the 10 Golf Challenge sponsor requests with highest pledge amounts. They will be featured on each tournament page. The final selection will be made May 1, 2022. Those not selected are not obligated to make any payment or donation of any kind. However, we hope they continue their marketing and fundraising campaign.

Fantasy Football
PFS will start accepting Fantasy Football League sponsor requests July 1, 2021 and start selecting sponsors with the highest pledge amounts August 1, August 15, and September 1 until 6 sponsors are secured for each tournament.

4. PROFAN SPORTS Obligations

PFS agrees to feature the Sponsor logo or video on the appropriate tournament page and link the logo or video to the website or webpage requested by the Sponsor. PFS provides a variety of programs, activities, and events to help increase sales and donations.

5. Sponsor Trademarks and Materials

Subject to the terms and conditions of this Agreement, the Sponsor grants PFS the right to use the Sponsor’s trade names, logo designs, trademarks, and company descriptions as provided by the Sponsor. These assets may be used in advertising or marketing programs and materials displayed and distributed solely in connection with the PFS Golf Challenge or the Fantasy Football Tournament of Leagues.

6. Indemnity

6.1 The Sponsor will indemnify, defend, and hold PFS harmless from and against any claims relating directly or indirectly to, or arising out of, any content posted on the PFS website, social media and other marketing materials.

6.2 PFS will not be responsible for damage to or loss of property belonging to the Sponsor, its employees, contractors, or agents  or for personal injury to the Sponsor’s employees, contractors, agents, directors, or invitees except to the extent that claims may be solely and directly attributed to willful misconduct or gross negligence of PFS and PFS’s employees, directors, and officers.

7. Limitation of Liability

In no event shall either party be liable to the other party for any consequential, incidental, indirect, or punitive damages regardless of whether such liability results from breach of contract, breach of warranties, tort, strict liability, or otherwise.

8. Term and Termination

8.1 PFS may terminate this Agreement at any time for any reason. In the event that the PFS terminates this Agreement for any reason other than Sponsor’s breach of Agreement, PFS shall refund any fees received from the Sponsor and return any materials, equipment, hardware, or software loaned by the Sponsor for the event.

8.2 The Sponsor may terminate this Agreement for breach of Agreement by PFS after giving PROFAN SPORTS at least ten (10) days prior written notice specifying the nature of the breach and giving the PFS at least ten (10) days to resolve such breach. If breach occurs less than ten (10) days before the event, Sponsor may terminate this Agreement if breach is not resolved by the first day of the event.
